Evictions

Neither the Hancock County Clerk nor staff may give legal opinion or advice; therefore, contacting an attorney may be best.

In Hancock County, Evictions, also known as Ejectments, are filed in Superior Court No. 1 or Circuit Court.  Either party to an Ejectment has the right to be represented by an attorney or represent themselves.  An Ejectment may be filed based on non-payment of rent, or other reasons.

The case fee is $156.00 to serve 1 defendant with an additional $10.00 for additional defendants.

As plaintiff you have the right to have the order of eviction served by the Sheriff by taking 3 copies of the Order of Eviction to the Sheriff along with a money order for $25.00 payable to the Sheriff.
